Booking Terms & Conditions

Terms & Conditions.

 

By choosing to hire the Artiste “As Known” listed above, you agree to the terms and conditions listed below, This contract is issued as confirmation of a verbal agreement between the Artiste and the Hirer. No signature is not sufficient to cancel this agreement.

 

Hirer will need to provide on the day of the event:

  • Suitable and safe electrical outlet sockets.

  • A small table for P.A to set upon. 

  • Parking at the venue.

  • A dressing room or green room (private changing area)

  • Soft drinks and water are to be provided on the night.

 

  1. This contract is issued as confirmation of a verbal agreement between the Artiste “As Known” listed above and the Hirer listed above. No signature is not sufficient to cancel this agreement.

  2. It is agreed that the fee, plus VAT if applicable, for each Engagement listed above shall be payable as per agreed terms.

  3. This contract does not provide for cancellation unless agreed upon by all concerned parties.

  4. Cancellation terms to the hirer:  in the event that the hirer cancels the engagement for reasons falling within their reasonable control, the client shall pay a cancellation fee directly to the artist (cancellation fee) to be calculated as provided below. The cancellation fee shall be calculated as a percentage of the final balance, such percentage to be determined with reference to the period of notice of the cancellation given to the artist prior to the date of the engagement, as follows:

    1.  up to 4 weeks’ notice 100% of the contracted fee to be paid.

    2. 4 to 8 weeks’ notice 75% of the contracted fee to be paid.

    3. 8 weeks and over notice 25% of the contracted fee to be paid (the deposit).

    4. Booking – to secure the booking a non-refundable deposit is to be paid within 4 weeks of receiving the booking confirmation.  

    5. Deposit – the deposit paid by the hirer to the artiste is non-refundable as per the terms.

  5. The Hirer and the Artiste acknowledge that the Cancellation Fee is calculated on the basis that it provides a genuine pre-estimate of the losses that will be incurred by the Artist as a result of the cancellation and is reasonable in all the circumstances.

  6. Artiste Cancelation – In the unlikely event that the artiste has to cancel the engagement and a replacement act cannot be supplied as per the terms of conditions, any deposit or monies paid in advance by the hirer will be repaid in full, within 14 days of the cancellation

  7. The agreement shall continue until the services have been provided in terms of the booking or any subsequent date as mutually agreed in writing by both parties or until terminated by either party in accordance with these terms and conditions.

  8. Any rights to terminate the agreement shall be without prejudice to any other accrued rights and liabilities of the parties arising in any way out of the agreement as of the date of termination.

  9. If a force majeure event affecting the artiste is so substantial in its effect or occurs so close to the performance date, that the artist cannot reasonably be expected to continue with the performance, then it may choose to cancel the contract but only with written confirmation to the client. 

  10. The Hirer and the Musician agree that the equipment and instruments of the Artiste are not available for use by any other person, except by specific permission of the Artiste.

  11. The Hirer shall ensure a safe supply of electricity and the security of the Artiste and his or her property at the venue.

  12.  The Hirer shall not make or permit the making of any audio and/or visual recording or transmission of the Artiste’s performance without the prior written consent of the Artiste.

  13. This Agreement may not be modified or cancelled except by mutual consent, in writing signed by both parties.

  14.  Any rider attached hereto and signed by both parties shall be deemed incorporated into this Agreement.

  15.  The Hirer and the Artiste agree on a ‘Safe Space’ principle in order to provide a working environment free from harassment and discrimination. Find out more theMU.org/Music-Sector-Code-of-Practice.
